Simply Mel Living (“SML”) provides the Website to facilitate the sale of Products and the provision of the Services but is not responsible for all Content and makes no representation or warranty that the Content is complete or up to date. If any Content is provided by SML on the Website it uses its best endeavours to ensure at the time of publishing (as indicated by the published date of each section of the Website) that the Content provided by SML was complete to the best of SML’s knowledge.
“Administrator” means any representative of SML who can create new accounts for members including You to have access to the Website;
“AUD” mean the currency of the Commonwealth of Australia;
“SML” means Melanie Green trading as Simply Mel Living ABN 86 296 231 214, its affiliates, business partners and their respective employees, officers, agents and contractors;

“Primary Payment” means any payment by You to SML of any fees or other amounts payable by You to SML under these terms and conditions;
“Products” means any goods or items displayed for sale on the Website;
“Services” means any course or programs displayed for sale on the Website;
“Tax Invoice” means an invoice in the format required by the law and which also shows the amount of GST payable by You in respect of the relevant primary payment;
“USD” means the currency of the United States of America;
“We”, “Us” means SML and the Website;
“You” means any user of the Website including Members.
2. Quality of the information
SML has made all reasonable efforts to ensure that all Content provided by SML on the Website is accurate and up-to-date. SML is not responsible for the accuracy of any Content provided by You. However SML cannot guarantee complete accuracy of the Content on the Website and assumes no legal liability or responsibility for the accuracy, currency or completeness of any information found on the Website. 5. Purchasing Online
5.1 Selecting a Product or Service
When You find a Product or Service on the Website which You would like to purchase, please insert the quantity you require in the appropriate box and click the “Add to cart” or “Purchase” button. By clicking the “Add to cart” or “Purchase” button, the Product or Service which You have selected in the quantity which You have selected will be added to Your shopping basket.
5.2 Purchasing a Product or Service
Unless specified otherwise, all prices quoted on the Website are in AUD and include GST where applicable.
Payment is to be made by any method that is detailed on our site from time to time.
All orders are subject to acceptance and availability. We reserve the right to refuse an order for any reason whatsoever.
Please ensure that all information You enter on our website is correct and accurate. We cannot make any changes or change the delivery address once You have placed your order.
Prices listed on the Website are current at the time your order has been placed. The prices can change from time to time.
Where permitted by Us, if You choose to pay in instalments a deposit of the amount set out in the summary of key terms is payable on registration for the Product or Service. You will then be invoiced for a further instalment (as specified on Our website) for the amount set out in the summary of key terms every thirty (30) days until the total price payable has been paid. Such invoices must be paid within seven (7) days of the date of the invoice.
You shall be responsible for all travel, accommodation and other subsistence costs and all other expenses incurred by You in connection with Your participation in a Service.
5.3 Delivery Charges
The total cost of the amount debited to Your card will be the price of the Products and Services at the time the order is placed plus any applicable shipping fee.
We deliver to any International address (excluding PO Boxes), by using Australia Post.
We aim to dispatch all orders, within seven working days of receipt unless otherwise stated on the website.
5.4 Our responsibility
We accept responsibility of any loss of, damage to, late delivery or non-delivery of goods ordered from our website. To the maximum extent permitted by law, You agree to release our carriers from any liability relating to the loss of, damage to, late delivery or non-delivery of any goods You order from this website and to assign all rights to claim compensation or insurance against our carriers to us and expressly and irrevocably do so by purchasing from Us.
(a) If we are liable by law for any GST on any Primary Payment, You must pay to us the amount of the GST.
(b) You must pay to us an amount in respect of any GST that You are required to pay under this Agreement:
(i) at the same time; and
(ii) in the same manner,
as You are required to pay for the Primary Payment to which the amount in respect of GST relates.
(c) We must issue to You a Tax Invoice in accordance with the requirements of the law relating to GST.
(d) If we refund to You any amount under this Agreement, we must also refund You an amount in respect of any GST that You paid in respect of that amount.
5.6 Product Availability
We update the availability information about the Products regularly. However, from time to time a Product may become unavailable between updates of availability information.
We use our best endeavours to deliver the Products You have ordered within the timeframe for delivery specified in Your order. Alternatively, You may cancel Your order, in which case if Your payment has been processed we will refund to You the purchase price. Please remember that the delivery times given in Your order are approximate and delays can sometimes occur. You will receive an email from us as soon as Your order is despatched. Also, all delivery times are based upon working days. You will become the owner of the Products You have ordered when Products have been delivered to You.
5.7 Service Rules
You agree that once a Service has been ordered and paid for, there are no refunds for cancellations by you. If a Service includes a scheduled appointment you must be punctual. If you are 15 minutes late (or more), the appointment is automatically cancelled.
5.8 Product Rules
Where you have purchased a Product that is provided in digital form (“Digital Product”), You agree that once a Digital Product has been ordered and paid for, there are no refunds on that product.
For all other Products, You agree that once a Product has been ordered and paid for, cancellations by you are only entitled to a refund at our discretion.
6. Security of the Website
6.1 The Internet is an insecure public network and transmissions may be viewed, intercepted or interfered with by third parties. SML accepts no responsibility or liability for interference with transmissions or any consequent loss or liability suffered by You.
6.2 SML has implemented security measures to provide You with peace of mind when You purchased Products from the Website. When You place an order on the Website, You will be redirected to an SSL secure page hosted by PayPal or Stripe where You will be able to enter Your credit card details securely. This method of ordering Products or services from the Website ensures the security of Your credit card details, as these details are submitted directly from Your browser to the PayPal or Stripe service, which only has a truncated version of Your credit card details.
6.3 You can obtain further technical information about PayPal or Stripe by visiting the PayPal Website – www.paypal.com or the Stripe Website www.stripe.com
6.4 We do not, at any time, have access to Your credit card details when You place an order on the Website.
6.5 We use our best endeavours to protect all information You provide us at all times, but we cannot be responsible for unauthorised access to that information.

(ii) the repair of the goods;
(iii) the payment of the cost of replacing the goods or of acquiring equivalent goods;
(iv) the payment of the cost of having the goods repaired;
b) in the case of services:
(i) the supplying of the services again; or
(ii) the payment of the cost of having the services supplied again.
7.2 To the extent permitted by law, SML is not responsible for any service or good provided by a third party supplier.
7.3 We do not exclude these rights but do exclude all other conditions and warranties implied by custom, law or statute
8. The Content of the Website and its affiliates is copyright
8.1 All rights in the Website are reserved by SML. In particular, no alterations, additions or adaptations of this Website publication are permitted by any company outside SML without written consent from the Editor.

10.4 The failure of SML to exercise or enforce any right or provision of the terms and conditions shall not constitute a waiver or any such right or provision. If any provision of the terms of service is found by a Court of competent jurisdiction to be invalid, the parties nevertheless agree that the Court shall endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of the terms and conditions shall remain in full force and effect.

You indemnify SML from any loss or damage You suffer if there is any unauthorised access to Your account.

12.7 Any applicant will need to complete the online application form which is available from time to time on the Website.

13.1 SML reserves the right to change these terms and conditions from time to time to reflect any changes in its business.
